1. Acceptance of Terms

Welcome to HappyHorse at https://happy-horses.org. By accessing or using HappyHorse, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the service.

2. Service Description

HappyHorse is an AI media generation platform with a focus on video workflows, including text-to-video, image-to-video, and related generation/editing features.

Model availability, output quality, duration, speed, and features may change over time. HappyHorse may rely on third-party AI providers and infrastructure.

3. Eligibility and Accounts

• You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use HappyHorse.
• You are responsible for account credentials and all activity under your account.
• You must provide accurate registration and billing information.
• You must notify us promptly about unauthorized account access.

4. Plans, Credits, Billing, and Renewal

HappyHorse may offer recurring subscriptions and one-time credit packages.

• Prices, features, and credit costs may change with notice.
• Subscriptions may auto-renew until canceled.
• You authorize us and our payment providers to charge applicable fees, taxes, and related charges.
• Credits are licensed, non-transferable, not legal tender, and cannot be redeemed for cash unless required by law.
• Where an expiration period is shown for credits, that expiration applies.
• Except where required by law, fees are non-refundable.

5. User Content and Responsibility

"User Content" includes prompts, uploads, source files, and other materials you submit to the service.

• You represent that you have all rights necessary to submit User Content and to request its processing.
• You are solely responsible for User Content and for how you use generated outputs.
• You grant HappyHorse a limited, non-exclusive, worldwide license to host, process, reproduce, transform, and transmit User Content only as needed to operate, secure, maintain, and improve the service.

6. Generated Output and AI-Specific Terms

• Subject to applicable law and third-party provider terms, you retain rights in outputs you generate.
• AI outputs may be inaccurate, incomplete, offensive, non-unique, or similar to outputs generated for other users.
• You are responsible for reviewing outputs before publication or commercial use, including legal compliance (copyright, trademark, privacy, publicity, and advertising rules).
• HappyHorse does not guarantee that any output is free from third-party claims.

7. Acceptable Use

You may not use HappyHorse to:

• Violate laws or regulations.
• Infringe intellectual property, privacy, publicity, or other rights.
• Generate or distribute unlawful, abusive, fraudulent, defamatory, or harmful content.
• Create non-consensual sexual content, child sexual content, or exploitative deepfake content.
• Bypass usage limits, safety controls, or security protections.
• Reverse engineer, scrape, interfere with, or disrupt the service.
• Use bots/automation in ways that degrade platform stability or evade billing.

We may monitor, investigate, remove content, refuse requests, or suspend accounts to enforce these Terms and protect users.

8. Third-Party Services

HappyHorse integrates third-party services (for example, payment processors and model providers). Their separate terms and privacy policies may apply when you use those integrations.

9. Intellectual Property of HappyHorse

HappyHorse and its software, site design, trademarks, and related materials are owned by the HappyHorse operator or licensors and are protected by law. These Terms do not transfer ownership of HappyHorse intellectual property to you.

10. Suspension and Termination

We may suspend or terminate access immediately if we reasonably believe you violated these Terms, created legal risk, or harmed service integrity.

You may stop using the service at any time. Termination does not eliminate obligations incurred before termination (including payment obligations).

11. Disclaimer of Warranties

HappyHorse is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, availability, or uninterrupted operation.

12. Limitation of Liability

To the maximum extent permitted by law, HappyHorse and its affiliates, officers, employees, and partners are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities.

To the maximum extent permitted by law, HappyHorse's aggregate liability for claims related to the service will not exceed the amount you paid to HappyHorse for the service in the 12 months before the event giving rise to liability.

13. Indemnification

You agree to defend, indemnify, and hold harmless HappyHorse and its affiliates from claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from your User Content, your use of the service, or your violation of these Terms or applicable law.

14. Governing Law and Disputes

These Terms are governed by the laws applicable to the operating entity of HappyHorse, excluding conflict-of-law principles.

Any dispute will be resolved in the competent courts of the jurisdiction where the HappyHorse operating entity is established, unless mandatory consumer protection law in your jurisdiction provides otherwise.

15. Changes to Terms

We may update these Terms from time to time. Changes become effective when posted. Continued use of HappyHorse after updates means you accept the revised Terms.
